Application means the software program, named MagicWave, provided by the Company and downloaded by You on any electronic device.

Information Collected while Using the Application

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission: Pictures and other information from your Device's camera and photo library.

We use this information to provide features of Our Service and to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be simply stored on Your device.

You can enable or disable access to this information at any time, through Your Device settings.

Use of Your Personal Data

We act as a data controller and a data processor in terms of the GDPR when handling Personal Information, unless we have entered into a data processing agreement with you in which case you would be the data controller and we would be the data processor.

Our role may also differ depending on the specific situation involving Personal Information. We act in the capacity of a data controller when we ask you to submit your Personal Information that is necessary to ensure your access and use of the Services. In such instances, we are a data controller because we determine the purposes and means of the processing of Personal Information and we comply with data controllers’ obligations set forth in the GDPR.

We act in the capacity of a data processor in situations when you submit Personal Information through the Services. We do not own, control, or make decisions about the submitted Personal Information, and such Personal Information is processed only in accordance with your instructions. In such instances, the User providing Personal Information acts as a data controller in terms of the GDPR.

ADDITIONAL INFORMATION FOR CALIFORNIA RESIDENTS

California Consumer Privacy Act (“CCPA”)

The CCPA requires us to provide our users who reside in California with the additional notice below.

 We may still require you to directly verify your identity and confirm that you provided the authorized agent permission to submit the request.

Minors

If you are a California resident under the age of 18 and you wish to remove content that you publicly posted, you may submit a request by contacting us at  feedback@metaelementsinc.com

Removing the public content does not ensure complete or comprehensive removal of the content or information.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page.
